I think the question is deceiving. First of all no “immigrants” were there…..”illegal immigrants” were, a distinction conveniently ignored in order to beautify illegals while demonizing law enforcement officers. Secondly, while there were indeed outdoor pens, they were not the permanent residency for prisoners, but rather temporary holding areas to be used to hold someone for a period of a few hours. To those who would still consider this cruel and unusual punishment, I would have to ask where were you during Sheriff Joe Arpaio’s tenure in Maricopa County, Arizona? He kept county prisoners in outdoor open walled tents for years under both republican and democratic administrations and was never shut down. It seems like this is more about getting Trump again than morality. Remember the ICE “Trump Cages” that illegal immigrant kids were likewise forced to endure? That story died very quickly when it was disclosed that the cages were actually from Obama’s tenure.

It was wrong both morally and Constitutionally. The Eighth Amendment is simple and clear: "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”
